HayberBooks Terms of Service

By using HayberBooks, you agree to these terms. They are a contract between you and HayberTech & Trade LLC, the company that operates HayberBooks. We've kept them as plain as possible.
If you don't agree, don't use the service.
1. What HayberBooks is
HayberBooks is a financial visibility tool for small business owners. It connects to your business bank account through Plaid, categorizes your transactions, and gives you a dashboard, weekly summaries, and answers to natural-language questions about your money.
HayberBooks is not:
- A bank, lender, or financial institution
- A bookkeeper, accountant, or CPA
- A tax preparation service
- A payroll service
- A licensed financial advisor
- A substitute for professional financial advice
We will tell you what we see in your bank data. We will not tell you what to do about it. Decisions about your business are yours to make.
2. Your account
To use HayberBooks you need to:
- Be at least 18 years old
- Be authorized to use the bank account you connect (it must be your business or you must have authority to view it)
- Provide accurate information at signup
- Keep your login credentials secure
You're responsible for everything that happens under your account. If you suspect unauthorized access, email us immediately at books@haybertech.com.
3. The free trial and billing
- HayberBooks costs $39 per month, billed monthly through Stripe.
- New accounts get a 14-day free trial with no credit card required.
- After the trial, you'll be asked to enter payment information to continue. If you don't, your account becomes read-only and stops processing new transactions.
- You can cancel anytime from your account. Cancellation takes effect at the end of your current billing period — we don't pro-rate refunds for partial months.
- We may change pricing in the future. If we do, we'll email you at least 30 days before the change applies to your account.
- If a payment fails, we'll retry, then email you, then suspend the account if it stays unpaid for 14 days.
4. What you can and can't do
You can:
- Use HayberBooks for your own business or businesses you have authority over
- Connect multiple bank accounts to the same HayberBooks account
- Export your data at any time
You can't:
- Resell HayberBooks or its outputs as your own service
- Reverse-engineer, scrape, or attempt to extract our code or models
- Use HayberBooks to process data for someone whose account you don't have authority to access
- Attempt to access other users' data
- Use HayberBooks for anything illegal, including but not limited to fraud, money laundering, or tax evasion
- Abuse our systems with automation, excessive requests, or attempts to bypass rate limits
If you do any of this, we may suspend or terminate your account without refund.
5. The categorization is best-effort
- Some transactions will be miscategorized. That's why we built the training UI — so you can correct them.
- The AI is not infallible. It can misread a merchant name, miscategorize an unusual transaction, or miss a recurring charge.
- You should review your data, especially before relying on it for any decision (tax filing, loan application, financial planning, etc.).
- We are not your books of record. If you need official accounting records, work with a CPA. HayberBooks is a visibility layer, not your general ledger.
6. Bank data
When you connect a bank, you authorize HayberBooks (via Plaid) to:
- Read your transaction history
- Read your account balance
- Continue reading new transactions on a schedule
You do not authorize us to move money. Plaid's read-only connection means we cannot initiate transfers, payments, or withdrawals. We have no ability to do this even if we wanted to.
You can disconnect your bank at any time from your dashboard. When you do, we delete the encrypted access token immediately.
7. AI and your data
When you use "Ask your books" or our automatic categorization, your transaction data is sent to Anthropic's Claude API. Anthropic's API has zero data retention by default — they do not store, log, or train models on your data.
If you object to AI processing your data, email us. We can offer manual-only mode, which limits what HayberBooks can do but keeps your data out of AI systems.
8. Service availability
We aim for high uptime but we don't guarantee it. HayberBooks may be unavailable for maintenance, third-party outages (Plaid, Supabase, Vercel, Anthropic, Stripe), or things outside our control.
If a third party (like your bank, or Plaid) is unable to provide your data, HayberBooks will be unable to show it. We are not liable for third-party failures.
9. Termination
You can terminate at any time by cancelling from your account or emailing us.
We can terminate or suspend your account if you violate these terms, don't pay, we suspect fraud, we're required to by law, or we discontinue HayberBooks (we'd give you 60 days' notice and an export of your data).
10. Limitation of liability
HayberBooks is provided "as is." We make no warranties — express or implied — about merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Our liability is capped at the amount you paid us in the 12 months before the claim. That means if you've paid us $39, our maximum liability is $39.
We are not liable for:
- Lost profits, revenue, or business opportunities
- Data loss or corruption beyond what's recoverable from backups
- Decisions you made based on HayberBooks' output
- Third-party service failures
- Anything caused by your own actions or those of someone you authorized
Some jurisdictions don't allow these limitations. If you live in one, this paragraph applies to you only to the maximum extent your law allows.
11. Indemnification
If someone sues us because of something you did with HayberBooks, you agree to defend us and pay any resulting costs.
12. Changes to these terms
If we change these terms materially, we'll email you at least 30 days before the change takes effect. Minor edits we may make without notice but will note the "last updated" date above. Continuing to use HayberBooks after a change means you accept the new terms.
13. Governing law
These terms are governed by the laws of the state in which HayberTech & Trade LLC is registered, USA. Any dispute will be resolved in the state or federal courts located in that jurisdiction.
If a dispute arises, we both agree to try to resolve it informally first by emailing books@haybertech.com.
